A rent agreement is a legal document that binds landlord and tenant and serves as evidence in case of any dispute. As per section 49 of the registration act, if you want to rent out your property over the period of 11 months, then it is mandatory to register a rent agreement. 

A registered rent agreement means a written agreement on which stamp duty and registration fees is paid. The benefit of having a registered rent agreement is it can be admitted as proof in court. 

Just like other various online facilities, few states in India also allow for online rent agreement registration.

Documents Required For Online Rent Agreement Registration:

  • Ownership documents of the property
  • Two passport-sized photographs of landlord, tenant, and witnesses 
  • Copy of identity proof of both the parties (i.e.,Voter ID card, driving license, etc.)
  • Copy of Aadhar card

How To Register Rent Agreement Online? – Online Rent Agreement Registration Process:

Online rent agreements are executed on e-stamp paper, which shall be signed by both parties. For online rent agreement registration, you must have a registered biometric scanner for thumb scanning, and the parties must be present while registering the agreement. After that, here are the simple steps to register rent agreement online:

Step 1: Visit the official government website (website of state government, e.g., http://efilingigr.maharashtra.gov.in/ereg/ – for Maharashtra, where you want to register rent agreement)

Step 2: Click on the online rent agreement option showing on the home page of the website.

Step 3: Choose your jurisdiction from the drop-down list

Step 4: Fill in the required details, including property details and identity details. Similarly, fill in the details of the other party (i.e., tenant)

Step 5: Submit the details of all the parties, i.e., landlord, tenant, and witnesses. 

Step 6: Upon successful submission, the landlord is required to pay stamp duty charges and registration fees online by generating an online challan. 

At last, parties may require booking an appointment with ASP for biometrics and photos. However, it depends upon the state to state.

Details To Be Included In The Rent Agreement: 

Here are the important clauses that both parties should consider and include in the rent agreement:

  • Duration of the tenancy (i.e., Agreement period)
  • Date of execution of the agreement 
  • Terms of payment  
  • Amount of monthly rent and security deposits         
  • Other usage charges such as parking, electricity, water, cleaning, and maintenance charges
  • Terms and conditions for renewal of agreement
  • Yearly enhancement in the rent charges
  • Details about stamp duty and other registration charges
  • Details about lock-in period and notice period 
  • Penalty for delayed payments
  • Sub-letting provisions (usually not permitted by the landlord)
